DELHI GRANTS EXEMPTION TO ESTABLISHMENTS ALLOWING NIGHT SHIFT FOR WOMEN

As per the notification no F.No.28lAddl.LClExemp/S&E, Actl202ll2438 dated 7th Aug 2025, Delhi Labour Department granted exemptions to all shops & establishments except Liquor shops from section 14, 15, and 16 of Delhi Shops & Establishment Act, 1954. As per the notification, there were addition of entries after the existing entries at serial no 300 under Schedule –I under "Establishment etc." of the Act. Two entries are to be added after serial no 300. Under the added serial no 301 & 302, following are some of the conditions which is to be added:

  • One Holiday must be given to every employee in a week. Working hours must be fixed - Max 9 hours daily and 48 hrs weekly.
  • Employer must adhere to fixed working hours as provided under the act.
  • Employer must obtain written consent from women employee and provide transportation facility if she is required to work at Night. Wage must be paid by Cheque/Electronic Clearing Service.
  • Provide basic amenities like restrooms, clean drinking water etc, install CCTV, refrain footage.
  • Every applicable establishment must comply with the provisions of POSH, Min Wages Act etc.
