Mandatory Paid Holiday on Election Day in West Bengal Kerala Assam & Puducherry

The Election Commission of India has issued a notification dated 16th March 2026 (Ref. No. 78/EPS/2026), mandating a one-day paid holiday for all eligible workers/employees who are voters in the respective poll-bound states.

This requires employers and company HR heads to fully comply with Section 135B of the Representation of the People Act, 1951, which ensures that employees are able to cast their vote without any deduction in wages.

Non-Compliance Penalty- If any Employer contravenes this order, then such employer shall be punishable with fine, which may extend to INR 500 and further action may be initiated as per applicable law.

Exception Provided- This provision shall not apply to voters whose absence from duty may cause danger or substantial loss in respect of the employment in which they are engaged.

Election Schedule:

  1. 9th April 2026 – Assam, Kerala & Puducherry
  2. 23rd April 2026 – Tamil Nadu
  3. 23rd April 2026 – West Bengal (Phase I)
  4. 29th April 2026 – West Bengal (Phase II)
